L(aurière), Eusèbe (Jacques) de. De l’origine du droit d’amortissement. Paris, Jerôme Bobin 1692. Kl-8° (17 x 10 cm.). [6] Bl., 212 S., [1] Bl., 75 S., [1] Bl., 52 S. Moderner Halblederband mit Rückenvergoldung.

Barbier III, 745. – Einband fachgerecht erneuert, gutes Exemplar.
First edition of the first publication by the eminent French jurist E. J. de Laurière (1659–1728) who, together with Claude Berroyer and Claude-Alexis Loger, later edited the *Ordonnances des rois de France de la troisième race, recueillies par ordre chronologique* (Paris 1723–1728). – “No one has studied jurisprudence and the origin of laws more thoroughly than Laurière” (Voltaire). – At that time, ‘amortisation’ referred to the fiscal or legal redemption or authorisation required when land was transferred to ‘mainmorte’ (dead hand) – usually the Church or monasteries. As the Church paid no inheritance tax and retained its properties permanently, the King and feudal lords were continually deprived of revenue. Laurière examined the historical development of this legal institution in order to justify, from a historical and legal perspective, the prerogatives of the Crown and secular law over the claims of the Church. This work marks the beginning of his legal career, during which he rose to become one of the most important compilers and editors of ancient French customary law (Coutumes). – Binding professionally restored, a fine copy.
– Reliure neuve, bel exemplaire.
